What is Artists for Biden?

 

Artists for Biden is an online-only sale of works donated by over one hundred leading contemporary artists to support the Biden Victory Fund. One hundred percent of proceeds from Artists for Biden will go to the Biden Victory Fund, a joint fundraising committee authorized by Biden for President, the Democratic National Committee, and forty-seven state Democratic parties to put Joe Biden and Kamala Harris in the best position to beat Donald Trump and to ensure Democratic victories up and down the ballot. 

Featuring artists represented by a range of galleries, the sale is hosted on Platform.art, a new stand-alone website for Platform, an initiative developed by David Zwirner to host online sales for industry peers and partners. 

 

What is the Biden Victory Fund?

 

The Biden Victory Fund is a joint fundraising committee authorized by Biden for President, the Democratic National Committee, and forty-seven state Democratic parties. All donations will help ensure that the Biden campaign will have the resources it needs and that the Democratic Party can fund critical programs for the Biden campaign and Democrats down the ticket through Election Day.

How will the Biden Victory Fund use the funds raised from Artists for Biden?

 

All proceeds raised by Artists for Biden will go toward the campaign of Joe Biden and Kamala Harris for President and Vice President and the Democratic Party. The funds will be used to ensure that the campaign has the resources it needs and the Democratic Party can fund programs on which the Biden campaign and Democrats rely through Election Day.

What is Platform?

 

Platform is an online space developed by David Zwirner to host art exhibitions, sales, and projects. Launching as a stand-alone website in September 2020, Platform draws on the gallery’s industry-leading experience in online sales and digital innovation to create a marketplace to offer art online to a global audience of collectors.

Platform emerged in the spring of 2020 from David Zwirner’s initiative to host peers, colleagues, and friends on the gallery’s online platform at a moment when physical galleries were temporarily closed in response to the global health crisis. Recognizing that not all galleries have the resources, technological infrastructure, or audiences to produce and sustain digital sales, David Zwirner hosted online presentations from forty-nine galleries from five cities during the period of lockdown, ultimately leading to the creation of the Platform website.

David Zwirner is the founder of David Zwirner, a leading contemporary art gallery with locations in New York, London, Paris, and Hong Kong representing seventy artists and estates.

 

Artists and Artworks

 

How are the artists featured on your website involved?

 

Each artist, artist’s estate, or collector has donated the value of an artwork in the form of an in-kind contribution to the Biden Victory Fund for the purpose of helping raise money for the campaign of Joe Biden and Kamala Harris and Democrats down the ticket. Through their participation, the artists acknowledge the importance of this moment and are showing their support for Joe Biden and Kamala Harris for the office of the White House and Democrats across the country.

 

What’s the difference between Featured Works and Buy Now Works?

 

The “Featured Works” in Artists for Biden are the premium artworks in the sale, most with a higher total value than the “Buy Now” works. All Featured Works will be managed and sold through the inquiry process and not be available via click to buy.

If you are interested in purchasing one of the Featured Works, please proceed to “Inquire.” You will be contacted by a representative from Artists for Biden or the artist representative, depending on the nature of your inquiry, to discuss the work and the terms of the sale.

The Jeff Koons edition is a Featured Work available to click to buy, pending availability.

Note that clicking “Inquire” does not bind you to acquiring the work. Furthermore, inquiring about a work does not secure the work for you.

For all other works, including the Jeff Koons edition, you will have the option to purchase the artwork immediately by clicking “Buy Now.” When you click “Buy Now,” you will be taken to a Platform.art page to complete your transaction with a credit or debit card. You must finish the payment process in order to confirm the sale. After finishing the transaction, you will receive an email from the campaign with next steps.

 

Do the works come framed or unframed?

 

An artwork will be unframed unless indicated as “framed” in the details provided in its caption or “Read More” page. If a work is not framed, its unframed dimensions will be listed in its caption. If the work is unframed, the framing costs are the responsibility of the buyer. Some artists, galleries, or studios will have quotes available for framing once a work is purchased.

 

Contributions and Eligibility

 

Who can buy works from Artists for Biden?

 

The purchase of a piece of work from Artists for Biden is a contribution to the Biden Victory Fund. Therefore, all buyers need to meet the legal and campaign rules.

In order to purchase a work, the buyer must meet the following requirements:

  • They are a US citizen or lawfully admitted permanent resident (i.e., green card holder).
  • The contribution must be made from the buyer’s own funds, and funds cannot be provided to the buyer by another person or entity for the purpose of making the contribution.
  • They are making this contribution with their own personal credit card and not with a corporate or business credit card or a card issued to another person.
  • They are at least eighteen years old.
  • They are not a federal contractor.
  • They are not registered as federal lobbyists or under the Foreign Agents Registration Act.
  • They are not SEC-named executives of fossil fuel companies (i.e., companies whose primary business is the extraction, processing, distribution, or sale of oil, gas, or coal).

How do I know if I’m qualified to buy a work from Artists for Biden or donate to the Biden Victory Fund?

 

If you meet the above contribution requirements for the Biden Victory Fund, you are likely qualified to purchase work from Artists for Biden. If you have made a payment on a “Buy Now” work and you do not meet the contribution requirements, you will receive a notification from the Biden Victory Fund who will refund your payment.

 

What if I just want to donate to the Biden Victory Fund?

 

You have the option to donate directly to the Biden Victory Fund by visiting joebiden.com.

 

I’m an American citizen/green card holder but living internationally right now; can I still purchase/donate?

 

Yes, given that you also comply with the campaign’s other requirements. The Biden Victory Fund may request a scan of the photo page of your US passport or green card.

 

Inquiries, Payments, and Purchases

 

When I click “Inquire,” what happens?

 

When you click “Inquire,” you will be asked to give your contact information. A representative from the Biden Victory Fund will follow up with you and will connect you with a representative of the artist to discuss the work with you. Clicking “Inquire” does not bind you to acquiring the work. Furthermore, inquiring about a work does not secure the work for you. If you are interested in making an offer on a Featured Work, please indicate so when inquiring.

 

When I click “Buy Now,” what happens?

 

A selection of works in Artists for Biden can be purchased immediately. When you click “Buy Now,” you will be taken to a page on Platform.art to complete your transaction with a credit or debit card. You must finish the payment process in order to confirm the sale. After finishing the transaction, you will receive an email from the Biden Victory Fund with next steps. If you did not receive a confirmation email but your credit card has been charged, please email [email protected].

 

When I click on “Buy Now,” I’m redirected to another website; what’s going on here?

 

All “Buy Now” transactions for Artists for Biden will be hosted for viewing on checkout.platform.art and processed by the secure ecommerce website BigCommerce, which operates a mini-store paid for by the Biden Victory Fund.

 

How does payment work?

 

If you purchase an artwork via the “Buy Now” button, your payment will be processed via debit or credit card through a mini-store hosted by the secure ecommerce website BigCommerce. If you purchase an artwork via the “Inquire” button, you will be connected with a representative from the Biden Victory Fund to complete your purchase.

 

Can I pay with a credit card, check, or wire transfer?

 

“Buy Now” works only accept a credit or debit card payment; note that purchases cannot be split across multiple cards. “Featured Works” or “Inquiry-only” works will accept wire transfer and other modes of payment.

 

Is my purchase/donation tax deductible?

 

 

An artwork purchase from Artists for Biden is a contribution to the Biden Victory Fund. Contributions or gifts to the Biden Victory Fund are not tax deductible.

 

 

Do prices include sales tax?

 

Prices listed include all applicable sales and use taxes. 

 

What are the shipping costs and how do I receive my work?

 

The buyer is solely responsible for shipping costs. Shipping vendors will be determined by the participating artists and galleries. Shipping costs and timelines will be determined by the buyer and the artist representative.

 

Can I pick up my work in person?

 

The respective artist or gallery representative will let you know whether it is possible to pick up your work in person.

 

What if I am subject to pay-to-play restrictions, such as MSRB Rule G-37 or SEC Rule 206(4)-5, but want to participate?

Biden Victory Fund accepts contributions of up to $721,300 from a person and $345,000 from a multicandidate committee (“PAC”). The first $2,800/$5,000 from a person/PAC will be allocated to Biden for President. The next $35,500/$15,000 from a person/PAC will be allocated to the DNC. The next $150,000/$75,000 from a person/PAC will be split equally among the Democratic state parties from: AZ, CO, FL, GA, MI, MN, NC, NE, NH, NV, OH, PA, TX, VA, and WI. The next $110,000/$55,000 from a person/PAC will be split equally among the Democratic state parties from: AL, DE, KS, LA, MA, MD, MS, NJ, NY, VT, and WV. The next $210,000/$105,000 from a person/PAC will be split equally among the Democratic state parties from: AK, AR, CT, DC, HI, ID, IN, KY, ME, MO, MT, ND, NM, OK, OR, RI, SC, TN, UT, WA, and WY. Any additional funds will be allocated to the DNC. A contributor may designate his or her contribution for a particular participant by contacting [email protected] The allocation formula above may change if following it would result in an excessive contribution. Contributions will be used in connection with federal elections, may be spent on any activity as each committee determines in its sole discretion, and will not be earmarked for any particular candidate. Federal law requires us to use our best efforts to collect and report the name, mailing address, occupation, and name of employer of individuals whose contributions exceed $200 per election cycle. AFB20, LLC (“AFB20,” “we,” “us,” and “our”) is an affiliate of David Zwirner Gallery, LLC and David Zwirner, Inc. (“Zwirner”) that is providing a digital platform for an online sale of works of art to be sold to benefit the Biden Victory Fund (“BVF”) through the websites www.artistsforbiden.org and https://platform.art/biden (together, the “Site”).

These Terms and Conditions (“Terms”) set forth the terms and conditions of your use of Site.

Please read these Terms carefully. By accessing the Site, you agree to be bound by and comply with the Terms. If you do not agree to these Terms, you may not access the Site.

 

Artwork Purchases

 

All the transactions relating to the artworks displayed on the Site will be directly concluded between the buyer and the donor of the artwork. Neither AFB20 nor Zwirner, will be a party to, nor bear any responsibility for, such transaction, except to the extent that, like other galleries, Zwirner is assisting with the effectuation of any transaction involving an artist that it represents. Neither AFB20 nor Zwirner will receive any commission with respect to such transaction.

If you click on the “Inquire” button to get more information about or express interest in an artwork displayed on the Site, your information will be shared with BVF. By submitting an inquiry about an artwork, you agree to our disclosure to BVF of any information you provide through the Site.

If you click on the “Buy Now” button to purchase an artwork, you will be directed to a Third-Party Website (as defined below) controlled by BVF to complete the purchase.

All purchasers and potential purchasers of any artwork through the Site will be vetted by BVF.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction and venue of the United States District Court for the Southern District of New York located in the Borough of Manhattan in the City of New York or, only if such court does not have subject-matter jurisdiction, the Supreme Court of the State of New York, New York County.

You irrevocably agree to bring any claim or dispute relating to your use of the Site and these Terms exclusively in the state and federal courts located in New York, to submit to the exclusive jurisdiction of those courts, and to waive any jurisdictional, venue, inconvenient forum, or other objections to those courts. Section titles and headings are for convenience only and have no legal or contractual effect. The failure of AFB20 to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If a court of competent jurisdiction determines that any provision of these Terms is unenforceable for any reason, then that provision will be deleted and the remaining provisions will be enforceable to the fullest extent permitted by law.

Information Automatically Collected

We may also collect information about users when you interact with the Site. We will share Personal Information you provide to us to BVF for the purposes of BVF facilitating the purchase of artwork you have inquired about or purchased through a link to a Third-Party Site and for any other lawful purpose.

We may also share your Personal Information with Zwirner and its affiliates and Service Providers, such as Mailchimp, that help us operate and provide services in connection with the Site.

We may use independent contractors or consultants, including Zwirner, to perform services for AFB20. These individuals and entities may have access to Personal Information only as needed to perform their functions and are obligated to maintain the confidentiality of any Personal Information collected from the Site.

We also reserve the right to disclose and use Personal Information and other information in special circumstances, including to enforce this Privacy Policy or any other part of our Terms, to comply with legal process or law enforcement, to address actual or suspected illegal activity, to protect our property or rights, to protect the rights and safety of anyone, or for other reasons we determine in good faith are necessary, appropriate, or required by law. If we ever merge with, are acquired by, or otherwise consolidate with another entity, Personal Information may be transferred along with our other assets.

Participation & Allocation

Participation Eligibility

 

To participate in Artists for Biden, you must be a US citizen or lawfully admitted permanent resident; at least eighteen years of age; and not a federal contractor, in accordance with campaign finance laws. This contribution must be made from your own funds and not funds provided by another person or entity for the purpose of making this contribution.

The purchase of a piece of work from Artists for Biden is a contribution to the Biden Victory Fund. Therefore, all Artists for Biden participants need to meet the legal and campaign rules. Purchasers and artists who are legal permanent residents of the United States can also participate. The campaign will need a copy of the Green Card/Permanent Resident Card.

In order to purchase a work, the buyer must meet the following requirements:

  • They are a US citizen or lawfully admitted permanent resident (i.e., green card holder).
  • The contribution must be made from the buyer’s own funds, and funds cannot be provided to the buyer by another person or entity for the purpose of making the contribution.
  • They are making this contribution with their own personal credit card and not with a corporate or business credit card or a card issued to another person.
  • They are at least eighteen years old.
  • They are not a federal contractor.
  • They are not registered as federal lobbyists or under the Foreign Agents Registration Act. 
  • They are not SEC-named executives of fossil fuel companies (i.e., companies whose primary business is the extraction, processing, distribution, or sale of oil, gas, or coal); or foreign nationals.

Allocation Formula

 

Contributions or gifts to Biden Victory Fund are not tax deductible.

Biden Victory Fund accepts contributions of up to $721,300 from a person and $345,000 from a multicandidate committee (“PAC”). The first $2,800/$5,000 from a person/PAC will be allocated to Biden for President. The next $35,500/$15,000 from a person/PAC will be allocated to the DNC. The next $150,000/$75,000 from a person/PAC will be split equally among the Democratic state parties from: AZ, CO, FL, GA, MI, MN, NC, NE, NH, NV, OH, PA, TX, VA, and WI. The next $110,000/$55,000 from a person/PAC will be split equally among the Democratic state parties from: AL, DE, KS, LA, MA, MD, MS, NJ, NY, VT, and WV. The next $210,000/$105,000 from a person/PAC will be split equally among the Democratic state parties from: AK, AR, CT, DC, HI, ID, IN, KY, ME, MO, MT, ND, NM, OK, OR, RI, SC, TN, UT, WA, and WY. Any additional funds will be allocated to the DNC. A contributor may designate his or her contribution for a particular participant by contacting [email protected] The allocation formula above may change if following it would result in an excessive contribution. Contributions will be used in connection with federal elections, may be spent on any activity as each committee determines in its sole discretion, and will not be earmarked for any particular candidate. Federal law requires us to use our best efforts to collect and report the name, mailing address, occupation, and name of employer of individuals whose contributions exceed $200 per election cycle. The Biden Victory Fund does not accept contributions from corporations or their PACs, unions, federal contractors, national banks, those registered as federal lobbyists or under FARA, SEC-named executives of fossil fuel companies, or foreign nationals.
